Cancellation Policy

Due to arrangements made with our vacation hosts, there can be no exceptions to this policy.

Client Cancellation

If you need to cancel any retreat with Embrace Your Odyssey, cancellation fees will apply in the form of your deposit or a percentage of sums paid. Any notice of cancellation must be provided in writing.

Please refer to the following for a breakdown of applicable cancellation fees:

  • If you cancel within 7 days of purchase: Full refund minus the non-refundable deposit (€ 500 - Early Bird) 

  • If you cancel 120 days or more before the retreat Start Date, you will be refunded 50% of any sums paid. This excludes the € 500 Early Bird deposit per person which is non-refundable.

  • If you cancel 90-120 days before the retreat Start Date, you will be refunded 25% of any sums paid. This excludes the € 500 deposit per person which is non-refundable.

  • Cancellations less than 90 days before the retreat Start Date are non-refundable and will result in a forfeit of any and all sums paid. This includes cancellation due to missed flight connections, illness, or any other scenario which results in your missing the retreat departure time.

Amenities in the retreat come as a package but are voluntary. You may choose not to participate in any of the retreat activities, but you may not receive a refund for activities, accommodations, amenities, services or any other aspect of the retreat that you do not use or engage with. Changes may be considered on a case by case basis. There is a change request fee of € 75 in addition to any changes incurred with our suppliers. 

In case of cancellation, you may transfer your deposit or your reservation to another person as long as you notify Embrace Your Odyssey at least 28 days before the Retreat Start Date. 
 

Vendor Cancellation

Cancellations may have to be made by Embrace Your Odyssey for ANY reason including weather, illness, vendor/facilitator/client unavailability, national and state emergencies, political instability, or Acts of God. In any of these events, Embrace Your Odyssey, LLC will make attempts to provide alternative arrangements to the best of our ability. 

If Embrace Your Odyssey LLC, has to cancel the retreat, you may request a refund of payments made by You to Embrace your Odyssey, which will be accommodated for insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your Retreat, these funds are non-retrievable and therefore non-refundable. This excludes the € 500 deposit per person which is non-refundable.
 

For trip cancellations or postponements made in connection with COVID-19, special terms apply:

Unfortunately, there are circumstances beyond any of our control regarding the global pandemic which has had and continues to have unfortunate and unforeseen consequences. At this time, Embrace Your Odyssey is unable to provide refunds due to travel changes associated with COVID19 or developments related to the virus. Please ensure that your travel insurance is able to protect you in the event of such changes. 

In the event you have to cancel your participation in this retreat, you will still have the option to receive one coaching session in lieu of a return of your deposit.

Private Session Cancellation Policy:

The following policy applies to all coaching sessions associated with the Embrace Your Odyssey retreat. Each guest is entitled to a total of three (3) sessions associated with the purchase of the Embrace Your Odyssey Retreat experience.  A session slot is defined as a forty five (45) minute scheduled block of time with an “inspirer” (coach/ facilitator) associated with the retreat. These are non transferable; they must be used by the client associated with the retreat spot. In the case that a session has been used, but the client cancels the retreat and transfers their spot to a new client may pay a fee of € 250 to reset the number of sessions available to 3 (three).  
 

Pre-Odyssey Preparation session must be scheduled by June 30, 2024 and completed between July 1, 2024 and August 10, 2024 or you will lose the right to that session. The Organizer highly recommends using your Pre-Odyssey Preparation Session as it will have a positive impact on your journey. This session has to take place before the retreat. 

In-Odyssey Session may be used during or after the Retreat and must be used before October 15, 2024. If you do not schedule and use your session by this date, you lose your right to that session. During the Retreat, you will discuss with your inspirer to find a time for your session. Due to time limitations, guests may not book more than one coaching session during the trip. 

The Post-Odyssey Session must be used after the retreat at least 7 days after the End Date and before October 15, 2024. If you do not schedule and use your session by this date, you lose your right to that session. 

These sessions are available once the guest has paid for the trip in full. Full payment for the trip must be completed before your first session. If payment is not received by your first session, it will be treated as a session cancellation, and you will lose your right to that session. If you would like to request a replacement session, you may. If your request is granted, the fee for the replacement session will be € 250. All terms and conditions apply to the replacement session.  No refunds will be given for missed or unused sessions. 

 

Private Session Rescheduling Policy

You may reschedule your private session up to 3 days prior to your session. There will be a rescheduling fee of $50. A rescheduling request made less than 3 days prior to the appointment is treated as a cancellation and replacement session request (see above).

7. HOW LONG DO WE KEEP YOUR INFORMATION?

 

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law. 

 

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We do not knowingly solicit data from or market to children under 18 years of age. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

Code of Conduct Intention:
Embrace Your Odyssey is committed to fostering a safe community. We require all those who participate in our community - including the Organization, Facilitators and Participants - to agree and adhere to this Code of Conduct in order to help us create a safe and positive community experience for all people. Our community becomes a compassionate, safe, and honest container for growth if all community members make conscious choices to keep it that way.  Even as kind, heart-centered individuals, we can still cause unintentional harm to others. Therefore, part of creating a safe community is to collectively recognize the impact of our behaviors and to actively work toward conflict resolution. Part of everyone’s role in creating a safe community is to take full responsibility for our impact on others regardless of our intent. 

Creating and maintaining safety is a dynamic process. So please don’t feel like you always have to have the “right” answer. These are our guidelines for community safety, and we’ll actively work with you to increase your safety throughout the Retreat should you need it. 

 

Should you be impacted by someone else’s behavior we will work with you to help you reach reconciliation and an experience of safety. Should you harm or violate someone else’s safety, we’ll work with you to reach reconciliation or hold you appropriately accountable for your actions. Harmful behaviors include but are not limited to: 

Repeated unwelcome sexual attention or advances. Public or private harassment. Offensive comments related to gender, gender identity and expression, sexual orientation, disability, mental illness, neuro(a)typicality, physical appearance, pregnancy status, veteran status, political affiliation, marital status, body size, age, race, national origin, ethnic origin, nationality, immigration status, language, religion or lack thereof, or another identity marker, including anti-Indigenous/Nativeness and antiBlackness. Trolling, insulting/derogatory comments, and personal or political attacks.  Insults, slurs, epithets, negative stereotyping, or other similar conduct. Publishing others’ private information, such as a physical or electronic address, images/photos, and/or private conversations, without explicit permission. Verbal or nonverbal threats of violence. Any form of physical violence. Deliberate intimidation or bullying. Deliberate "outing" of any aspect of a person's identity without their consent except as necessary to protect vulnerable people from intentional abuse. Questioning or challenging someone’s stated self-identity or chosen labels, even if they conflict with your own views. Refusing to use a person’s stated pronoun. Other conduct which could reasonably be considered inappropriate in a professional setting. 

 

  • I acknowledge the importance of fostering a supportive and harmonious environment during the retreat. I agree not to engage in any behavior that may harm, disrespect, or compromise the well-being of myself or fellow participants.

  • I understand that I may impact someone without realizing it and will make a conscious effort to understand that I have impacted them, seek reconciliation, and take next steps to ensure a safe environment for everyone.  

 

Shared Responsibilities: 

  • I acknowledge that there are responsibilities associated with sharing space including keeping my, and communal spaces clean, as well as cooking and cleaning duties for the group. I will uphold the responsibilities assigned to me, or come to a mutual agreement with my shipmate(s) to make sure my responsibilities are managed. 

 

Non-Disclosure of Personal Information:

I commit to respecting the privacy of fellow participants and refraining from sharing their personal contact information, stories, or any other identifiable details without their explicit consent.

 

Responsibility for Personal Belongings:

I understand that Embrace Your Odyssey is not responsible for the loss or damage of personal belongings during the retreat. I am solely responsible for safeguarding my possessions.

Reporting and Consequences for Conduct Violation: 

If you are being harassed, bullied, or notice that an Explorer or Inspirer is being harassed, or have any other concerns, please contact embraceyourodyssey@gmail.com. You may also talk to an Inspirer about your experience. If your complaint is about an Inspirer they will not handle your complaint directly but will be held accountable to the terms of this Code of Conduct. At our discretion, we may publicly name a person about whom we’ve received harassment or complaints, or privately warn third parties about them, if we believe that doing so will increase the safety of community members or the general public. We will not name harassment complainants without their affirmative consent. 

Embrace Your Odyssey may give feedback to you or the community about expected behaviors, harmful behaviors, rupture and repair within the community, request that you remove or edit written material 

 

  • I acknowledge that any breach of the confidentiality agreement, disrespectful conduct, or violation of the retreat rules may result in my immediate dismissal from the Embrace Your Odyssey retreat without the possibility of a refund. 

  • I understand that, if my retreat is prematurely terminated, Embrace Your Odyssey will not be held responsible for any associated inconveniences or travel costs, including but not limited to transportation, accommodation, or any expenses incurred due to discontinuing the retreat while on an island.

I hereby agree that by booking this retreat or associated services, I consent to waive certain legal rights, including the right to sue the Organizer named above, and, if applicable, its employees, owners, officers, directors, representatives, agents, volunteers and facilitators/ Inspirers from any physical, material, tangible or intangible, loss or damages that may happen to me during my participation in the Retreat.

I will be voluntarily participating in the Retreat that will be conducted by the Organizer. The Retreat may include, but is not limited to, the “Retreat Activities” described above.

I do not hold Embrace Your Odyssey  for any loss or damage to me or my property.

This Retreat Waiver will bind and be enforceable against me and all of my personal representatives. I agree that this Retreat Waiver should be enforceable to the fullest extent of the law, and if any portion is held invalid, the remainder should continue in full legal force and effect.

I specifically acknowledge and agree that this document is not intended to be a general release, which would be limited under some state and local laws.

This Retreat Waiver shall be construed and interpreted as broadly as possible in the applicable jurisdiction.

 

ACCIDENT WAIVER AND ASSUMPTION OF RISK: I understand and am aware that my participation in the Retreat involves risks. These risks may lead to tangible or intangible harm, and I agree that they may result not only from my own actions but also from the actions of others. With the knowledge and understanding of these risks, I choose, of my own will and volition, to participate in the Retreat.

I assume all risks associated with participating in any activities associated with Embrace Your Odyssey. These risks include those arising from negligence or carelessness, dangerous equipment or property, and the possible liability without fault. I certify my physical fitness for this activity and have not been advised against it by a medical professional. I acknowledge that this form will govern my actions during this activity and that it will be used by eventholders, sponsors, and organizers. 

I acknowledge that this activity may carry risks such as physical and mental challenges, potential injury, and property loss. I consent to receive medical treatment if deemed advisable in the event of injury, accident, or illness during this activity. I assume all expenses in this scenario. 

I acknowledge that travel comes with risk, including but not limited to injury, loss of possession or criminal activity. 

I am responsible for my own well-being and safety when moving around the islands visited. Embrace Your Odyssey is not responsible for accidents, criminal activity, or incidents when traveling around Athens or any of the islands on the itinerary before, during, or after the retreat. The Organizer cannot ensure the safety of any spaces navigated during the retreat including the area around the accommodation in the city of Athens, Greece, the various ports that will be visited and the islands visited. In the unforeseen and unexpected case of criminal activity, the Inspirers will support the victim to their greatest capacity including supporting them in finding the local enforcements who may help. 

I am aware that there are risks, which are not mentioned in this document, that I may not have considered, yet I waive my right to any claims that may occur from these unconsidered risks and I choose, of my own will and volition, to participate in the Retreat.

I have read the Terms and Conditions and the above Liability Waiver fully and I understand and agree to its contents. I understand and agree that by accepting these terms (booking the Retreat), I forfeit any right, claim, or ability to hold the Organizer responsible for any tangible or intangible damages, loss of property, or loss of life that may occur during or after my use of the facilities and participation in the Retreat and associated activities.

 

HEALTH AND MENTAL HEALTH DISCLAIMER: Embrace Your Odyssey is not responsible for any mental distress that could result from the teachings offered during the retreat. Attending this retreat is not a guarantee that the Participant will become successful, or that the Participant’s emotional state will improve or change. Embrace Your Odyssey is not a mental health facility, or supplier. The Participant understands the Organizer and its subsidiaries, owners, principals, directors, executives, employees, staff, contractors, facilitators, or agents are not lawyers, physicians, managers, therapists, business managers, registered dietitians, financial analysts, psychotherapists, or accountants. The Participant understands their participation in this Retreat will not treat or diagnose any disease, illness, or ailment and if they should experience any such issues they should see their registered physician or other practitioner as determined by their own judgment. The Participant understands that the Retreat is not a substitute for health care or medical or nutritional advice of any kind. The Participant agrees to seek medical advice as determined by their own judgment before starting this or any other Retreat or discontinuing use of any medications as prescribed by their medical practitioner. The Participant understands and agrees that the Participant is fully responsible for their mental wellbeing during the Retreat, including their dietary, mental, and physical choices and decisions during the Retreat. The Participant understands that coaching or individual sessions are not psychological treatments and that Inspirers are not psychotherapists or practicing psychotherapy with Participants. The Participant understands that nothing stated herein is intended to be, and must not be taken to be, the practice of medicine or medical advice.  Please inform Embrace Your Odyssey if you find out that you are pregnant during the Retreat or inform Embrace Your Odyssey at the beginning of the Retreat if you are already pregnant.  An additional waiver will be sent to you under separate cover. As advised when starting any new health or fitness regime while pregnant, please consult your physician or a medical professional prior to beginning this Retreat. The Embrace Your Odyssey Retreat is not a trauma resolution Retreat. If you carry significant trauma or struggle with self-regulation, serious mental health issues, such as severe anxiety, depression, sleep disorders, eating disorders, etc. and have not had any support around it (psychotherapy, somatic experiencing, medication, etc.) then this Retreat may not be the right fit for you. Please consult your physician or a medical professional prior to beginning this Retreat. The Participant understands they are fully responsible for any and all adverse reactions, including but not limited to, emotional or physical reactions to the content in the Retreat. The Participant has the ability to give their informed consent, and does hereby give such consent to the Organizer, to help them meet their goals. Additionally, the services are offered on an "as is," "where is," and "where available" basis, with no warranty of any kind — whether express, implied, or statutory — including, but not limited to, warranties of title or the implied warranties of merchantability or fitness for a particular purpose. This does not affect those warranties which are incapable of exclusion, restriction, or modification under the laws applicable to this agreement. The Participant accepts and agrees that the Participant is fully responsible for their progress and results from the Retreat. The Organizer makes no representations, warranties, or guarantees verbally or in writing regarding the Participant’s experience. The Participant understands that because of the nature of the Retreat and extent, the results experienced by each Participant may significantly vary. The Participant acknowledges there is no guarantee that the Participant will reach their goals as a result of participation in the Retreat. The Participant acknowledges that neither the Organizer, its affiliates, nor any of their respective employees, agents, third parties, or licensors warrant that the services will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the services, or as to the timeliness, sequence, accuracy, reliability, completeness, or content of any information or service provided through the Retreat. The Participant understands this is not a training in psychology nor will the Participant be able to practice psychology based on this training. The Participant understands that the Organizer does not offer any representations, warranties, or guarantees, verbally or in writing, regarding any results of any kind.  The Participant agrees that their results are dependent on various factors and in no way are dependent on any information the Organizer provides to Participant. Except as specifically provided in this agreement or where the law requires a different standard, you agree that the Organizer is not responsible for any loss, including financial loss, property damage, or bodily injury caused by participation in the Retreat. 

To the maximum extent permissible under applicable law, the Organizer will not be responsible to the Participant or any third party claims through the Participant for any direct, indirect, special or consequential, economic or other damages arising in any way out of participation in the Retreat and the maximum amount that the Organizer would be liable is the fees paid for the Retreat.

 

PHOTO AND VIDEO RELEASE I understand that I may be photographed or filmed during this Retreat, I hereby grant Embrace Your Odyssey, its representatives, assigns, and employees the right to take photographs and/or video recordings of me in connection with the Embrace Your Odyssey event/retreat and connected events. I authorize Embrace Your Odyssey to use and publish the same in print and/or electronically for advertising, marketing, web design, social media and any purposes that arise. 

I agree that Embrace Your Odyssey may use such photographs and/or video recordings of me with or without my name and for any lawful purpose, including but not limited to publicity, illustration, advertising, and web content.

Usage: Embrace Your Odyssey may use the photographs and/or video recordings taken at the event/retreat for promotional purposes including, but not limited to, brochures, flyers, websites, social media, and other marketing materials.

Duration: This consent and release are given in perpetuity and does not require prior approval by me.

No Compensation: I understand and agree that I will not receive any compensation for the use of my likeness in such photographs and/or video recordings.

Revocation: This consent and release can be revoked at any time in writing. I agree not to indemnify Embrace Your Odyssey in the case that a photo has been published and will give Embrace Your Odyssey a minimum of 6 months and 3 attempts of direct communication via both phone and email with each attempt at communication to adjust media so that they I am not recognizable. My request for revocation is not a guarantee that the media will be removed or adjusted.

HOLD HARMLESS: 

Participant knowingly, voluntarily, and expressly waives any claim for damages including but not limited to injury or death Participant may sustain as a result of participating in this Retreat or in any way resulting from the services provided by the Organization or use of techniques and practices taught.

We at Embrace Your Odyssey, LLC are excited to serve our clients (hereinafter “Participant”, ”Explorer”,  “You”, “I”, “Guest”). Prior to booking services, please review the following Terms and Conditions.

Yoga, sightseeing, hiking, boating, swimming, eating, workshops, group activities, diving, coaching sessions, snorkeling, singing, dance, traveling by bus, car, and boat, other not specified.

Includes the trip (hereinafter  the “ Retreat”) which takes place between August 23, 2024 (hereinafter the Start Date) and August 31, 2024 (hereinafter the “End Date”) and scheduled activities associated with the Retreat including private sessions with Inspirers (hereinafter “Session”).

CONTRACT: 

Below are the Terms and Conditions of Retreat participation. These Terms and Conditions including all brochures, documents, correspondence, and the terms and conditions of the Organizer’s suppliers form the basis of the contract with You, the Participant.  Before making a booking with the Organizer You must ensure that You  have read and understood these Terms and Conditions. We also ask that the You address any questions You may have with us prior to booking. Please be aware that these Terms and Conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By asking Embrace Your Odyssey to confirm your booking You are accepting all the Terms and Conditions laid out below and acknowledging that You thave read the Terms of this Contract and agree with it. 

If You are making a booking as, or for, a group (more than one [1] person), You, as the leader of the group, are responsible for sharing these Terms and Conditions with all members of the group and are financially responsible for the booking.  Embrace Your Odyssey will not be liable for a group leader’s failure to share these Terms and Conditions with all Participants in their group.

You represent and warrant that (a) You  are of sufficient age to use Embrace Your Odyssey services and website and can create binding legal obligations in connection with your use, (b) You are legally authorized to act on behalf of those You represent and accept these Terms and Conditions on their behalf, and (c) the information supplied by You, or members of your group is true and correct.

The Terms described pursuant to this paragraph shall bind Participant’s heirs, executors, personal representatives, successors, assigns, and agents.


 

ACCESS AND TERMINATION OF ACCESS TO THE RETREAT: 

The Organizer  is committed to providing all Participants in the Retreat with a positive Retreat experience. You agree that the Organizer may, at its sole discretion, terminate this Agreement, and limit, suspend, or terminate your access to the Retreat and terminate any further services without refund if you become disruptive to the Organizer or the Retreat or upon violation of the terms as determined solely by the Organizer. The cancellation of your reservation or experience will result in the forfeiture of any monies paid for your reservation or experience and your being denied access or continued access to the applicable retreat related experience(s) or service(s). If the retreat is not paid in full, you will still be liable to pay the total contract amount. Furthermore, the Organizer reserves the right to discontinue your participation in the Retreat if the Organizer deems, in its sole discretion, you are unable to safely and effectively continue with the experience. The Organizer does not collect medical information about Participants. If the Organizer deems you unsuitable for Retreat due to any health or wellness related issues, the Organizer can decide to cancel your participation in the Retreat unless a written document from an appropriate medical provider states that you are suitable for participation in this Retreat and any necessary steps are taken so that the Organizer may confirm this information. If this is not accomplished, the situation will be handled as a cancellation at the date of the last communication regarding whether or not you were not able to attend. If a document form an appropriate medical provider is presented to the Organizer, the Organizer may still restrict access to the Retreat. 

 

The Organizer maintains the right to refuse service to any person at any time at its sole discretion to ensure a positive retreat experience for everyone involved. 

 

CHANGES TO THESE TERMS AND CONDITIONS: 

Embrace Your Odyssey reserves the right to change these Terms and Conditions at any time. You understand that, upon making changes, Embrace Your Odyssey will notify Participants via the email address provided at booking. The current terms will apply to my booking.  You  must therefore be familiar with the terms in effect at the time You book.  Your continued use of Embrace Your Odyssey’s services including continuing to use or maintain any bookings after notice of any changes to the Terms and Conditions constitutes your consent to the changes.

 

RETREAT STRUCTURE: 

The Retreat is scheduled to include:

  • One (1) nights accommodation in a shared Airbnb or hotel where Participants may have their own or a shared bed depending on availability. 

  • Seven (7) days and six (6) nights accommodation on a sailboat (one (1) of three (3) available for this Retreat) where Participants will have their own or a shared bed depending on the itinerary selected and availability. The boats are equipped with a kitchen, at least one bathroom and shower. Linens, and a towel for each Participant. Fuel, water, port fees and cleaning services at the end of the trip are included in the experience. Cleaning during the Retreat will be managed by the Participants. 

  • Meals: Breakfast, Lunch, Water, Coffee, Tea, Juice provided daily. Opening and closing dinner at a restaurant for the entire group on the first and last evening. 

  • Transportation from the Airbnb to the port in Lefkada and return transportation from the Port in Lefkada to the Airbnb. Participants will be responsible for airport transfers. 

  • On the retreat there are three (3) pathways to choose from. The Pathway you choose is not guaranteed but preferences will be factored into booking you on the boat of your preference. You will have the option to attend workshops from Pathways other than the one associated with your booking. 

  • Workshops provided by inspirers. Workshops will be 45 to 90 minutes depending on the material and take place daily. 

  • A total of Three (3) Individual Sessions to take place before during and after the Retreat. 

  • Professional skippers to sail the boats. 

  • Group yoga experiences, 

  • Walking tour in Athens. 

  • A sailing lesson if conditions allow. 

The Retreat shall NOT include: 

  • Travel Insurance (required for the trip, this is the Participants responsibility) 

  • Airfare 

  • Airport Transfers 

  • Dinners (with the exception of opening and closing dinner) 

  • Alcoholic beverages

Please note activities and amenities are subject to change dependent on weather conditions, schedule changes, or unforeseen circumstances. This decision will be solely made by the Inspirers based on venue availability, considerations from the captain, safety of the passengers, the crew, and the ship.


 

RETREAT DATES AND DEADLINES: 

Deadline to submit your € 500  deposit: June 20, 2024

Deadline to submit final payment: July 15, 2024. 

Deadline to schedule your Pre-Odyssey Session: June 30, 2024 

Deadline to schedule your Odyssey and Post-Odyssey Session: October 1, 2024

Trip portion of the Retreat: August 23, 2024 to August 31, 2024

Session availability: July 15, 2024 to October 15, 2024 

Participant understands all benefits shall expire on October 15, 2024 and will not be carried over. All of Participant’s benefits must be used prior to this date or they will be forfeited. 


 

PARTNERS AND FACILITATORS:

Your facilitators include Shanina Christina Halbert and Ekatarina Tartary. They are your “Inspirers” for the trip. They are independent agents contracted by the Organizer. The Organizer does not endorse statements, recommendations, or actions of the Inspirers. However, if the Inspirers engage in any behavior that is harmful, offensive, or not aligned with the Embrace Your Odyssey experience or your well-being, it is to be immediately reported in writing to embraceyourodyssey@gmail.com. The Organizer will manage the infarctions on a case by case basis. 

Suppliers have been vetted by review of online customer ratings, previous business interactions, referral, or more than one of these methods. 

Some services, including but not limited to: sailboat charter, bus transport, restaurants, and accommodations are services being performed by an independent third-party supplier and Embrace Your Odyssey, as the contracting organization, is not responsible for the supplier's negligence. The suppliers may have their own terms and conditions which apply to you. It is your responsibility to review these terms and conditions. Embrace Your Odyssey will provide a list of known supplies and vendors at your written request at embraceyourodyssey@gmail.com. By participating in the Retreat you are agreeing to Embrace Your Odyssey’s Terms and Conditions as well as the Terms and Conditions of all of our affiliated suppliers. Your interaction with any supplier is at your own risk. 

 

COMMUNICATION WITH EMBRACE YOUR ODYSSEY:

For questions regarding scheduling or the Retreat, please email:     embraceyourodyssey@gmail.com. The Organizer or one of it’s representatives will respond to Participant Service emails within five (5) working business days. Emails received on national holidays, or on a weekend will receive a response within the following five (5) working business days.

 

CONFIDENTIALITY:

The Organizer and Facilitators respect the Participant’s privacy and insists that the Participant respects the Organizer’s and the Facilitators’. Thus, consider this a mutual non-disclosure agreement. 

Any Confidential Information shared by any representative of the Organizer or Facilitator is confidential, proprietary, and belongs solely and exclusively to the Organizer or the Facilitator who shared the information. All Parties  agree not to disclose, reveal, or make use of any Confidential Information or any transactions, during discussions, emails, calls, video calls, or otherwise. The Participant agrees not to use such confidential information in any manner other than in discussion with the Organizer or its Facilitators related to the Retreat. Confidential Information includes, but is not limited to, information disclosed in connection with this Agreement, and shall not include information rightfully obtained from a third party. Both Parties will keep Confidential Information in strictest confidence and shall use the best efforts to safeguard the Confidential Information and to protect it against disclosure, misuse, espionage, loss, and theft. Further, the Participant agrees that if they violate or display any likelihood of violating this section the Organizer will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.

 

BOOKING:

In order to book a spot on the retreat, visit our website www.embraceyourodyssey.com. Click on any of the “Apply” buttons, this will bring you to a deposit submission page. Once your deposit is recieved, you will have access to an application page. Once you fill out your application for the Retreat, a team member from Embrace Your Odyssey will get back to you to confirm with your all the details. After submitting the application form you will be directed to the deposit payment page.   

 

PARTICIPANT INFORMATION: Please note that names provided to secure reservations must match Participant’s passport. The information that you provide at the time of booking will be used to secure your spot with our suppliers. It is your responsibility to review all travel documentation and alert us as soon as possible with any corrections. A change fee of € 50   may be applied. Participants voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation. Embrace Your Odyssey will not be responsible if you are not able to engage with any or all experiences in the retreat due to your failure to provide accurate information. In this event a refund will not be available.

PAYMENT AND PROMOTIONS: 

COST OF THE RETREAT: The cost of the retreat is listed in Euros. The cost is subject to change without notice for any reason including but not limited, currency fluctuations, government action, increased expenses, increased demand. Please refer to our website for the most up-to-date costs associated with the retreat. We do not price match, the cost at the time of booking is the cost you pay. Discounts are reviewed on a case by case basis and only accepted from our approved vendors. The Participant is liable for the total cost of the Retreat.

If full payment is not received by the final deadline (July 15, 2024), we reserve the right to cancel your travel. We will give one (1) to the supplied email notice prior to taking this action. Failure to make a payment may result in the cancellation of your travel.  In such a case this would be considered a cancellation by you and the cancellation terms and fees as described below would be in effect.

 

DEPOSIT: You may pay your €500  deposit to apply for a space on the retreat. The deposit is deducted from your final payment for the retreat. Paying a deposit does not guarantee the cost of your retreat, the cost can change at any time. We will honor the cost at the time you applied until 5 days after you have been accepted. After that point, any cost changes apply to your ticket. You must pay the full amount by the July 15, 2024, you will need to pay the full price for the selected, available room in order to attend the retreat. If your payment is past the final due date (July 15, 2024), this will be treated as a cancellation unless you pay in full and pay an additional late fee of €350. You are responsible for making payments in adherence with the deadline. Embrace Your Odyssey may send reminders but will not be responsible for late payments. By paying your deposit, you are agreeing to these Terms and Conditions. 

 

METHOD OF PAYMENT: The Participant shall pay by credit card, ACH transfer, check, Zelle, PayPal or any payment method available in the check out section of www.embraceyourodyssey.com at the time of payment. 

 

CREDIT CARD BOOKINGS. While we do accept major credit cards including Visa, Mastercard, American Express and Discover, Participants must provide to us a click authorization for every transaction for your trip. Your authorization is an agreement for us to charge your card and an acknowledgement and agreement to these terms and conditions including the cancellation terms. As such you agree not to make any improper chargebacks.

In certain cases, you can dispute charges with credit card companies (“chargebacks”). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Embrace Your Odyssey retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. Improper chargeback scenarios include: chargebacks resulting from non-cancellable reservations, whether or not the reservation is used, chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud, chargebacks resulting from force majeure or other circumstances listed in the Cancellation Policy. Chargebacks resulting because you do not agree with the cancellation policy.
 

PROMOTIONAL OFFERS: Unless otherwise indicated, these Promotion Terms and Conditions govern all promotional offers sent by the Organizer and its subsidiaries, affiliates, partners, including offers of savings, discounts and/or other benefits. Offers are limited to only the eligible purchases. Duplicate requests will constitute fraud. Theft, diversion, reproduction, transfer, sale or purchase of any offer is prohibited and constitutes fraud. These offers are void where prohibited, taxed, or restricted by law. Promotions are only redeemable in the manner stated by the Organizer.  All promotions are subject to availability. 

Partnered discounts such as coupon codes, offers based on connection to partners, or any possible discounts applied to the Retreat are subject to change without prior notice. Honoring these offers is at the sole discretion of the Organizer and its facilitators. €300  is the maximum discount that can be applied for any promotion unless specifically stated in writing. Promotions cannot be combined. 

 

INVITE A FRIEND DISCOUNT: Discounts for bringing another person on the retreat may be redeemed in the form of a refund or applied to additional individual sessions. This promotion is subject to confirmation prior to refund or credit is applied. Confirmation is dependent on the referred party clearly stating the full name and email address of the referring party and both parties paying for their space on the retreat in full. The discount is applied as a partial refund (of €150 to the referring Participant only). 

 

FINANCIAL ASSISTANCE STATEMENT: At Embrace Your Odyssey Retreats, we believe in making transformative experiences accessible. If you find that the cost of the retreat poses a financial challenge, we encourage you to reach out to us. We offer scholarship opportunities, and our team is available to provide information on the application process. Please note that scholarship availability is subject to space constraints on the boats and funding availability.

Scholarship applications will be managed on a case-by-case basis, prioritizing confirmed financial need. Your well-being and journey are important to us, and we are committed to exploring options that make participation feasible for everyone. CANCELLATION POLICY: 

Due to arrangements made with our vacation hosts, there can be no exceptions to this policy. 

 

PARTICIPANT CANCELLATION: If you need to cancel attendance with the Retreat, cancellation fees will apply in the form of your deposit and a percentage of sums paid. Any notice of cancellation must be provided in writing.

Please refer to the following for a breakdown of applicable cancellation fees:

If you cancel within 7 days of purchase: You will be refunded 100%. This excludes the €500 deposit per person which is non-refundable and the here below requirements shall be taken into account.

If you cancel 120 days or more before the Start Date: You will be refunded 50% of any sums paid. This excludes the €500 deposit per person which is non-refundable.

If you cancel 90-120 days before Start Date, you will be refunded 25% of any sums paid. This excludes the €500 deposit per person which is non-refundable.

Cancellations less than 90 days before Start Date are non-refundable and will result in a forfeit of any and all sums paid. This includes cancellation due to missed flight connections, illness, or any other scenario which results in your missing the retreat departure time. If payment has not been received, in full, by the Organizer by the Retreat Start Date, this will be treated as a cancellation, regardless of whether the Participant arrives for the Retreat. Payment can be completed at this time via cash or credit card but must be cleared before Guest can participate in the Retreat. 

If you cancel while your trip is in progress, for any reason, there is no refund for the unused portion.
 

PARTICIPANT TRANSFER: In case of cancellation, you may transfer your deposit or your reservation to another person as long as you notify the Organizer and make the change 28 or more days before the Start Date. 

In the case that a session has been used, and the Participant transfers their booking to a new Participant, a fee of €250 to reset the number of sessions available to 3 (three) will apply. The original Participant is responsible for this fee. 

The exclusion of the €500 deposit applies even if the Retreat was initially paid for in full.

VENDOR CANCELLATION OR CHANGES: Cancellations may have to be made by Embrace Your Odyssey for ANY reason including weather, illness, vendor/facilitator/participant unavailability, national and state emergencies, political instability, or Acts of God. In any of these events, Embrace Your Odyssey, LLC will make attempts to provide alternative arrangements to the best of our ability. We will inform you as soon as reasonably possible if we need to make make a significant change to your confirmed booking or to cancel. 

If Embrace Your Odyssey LLC, has to cancel the retreat, you may request a refund of payments made by You to Embrace your Odyssey, which will be accommodated for insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your Retreat, these funds are non-retrievable and therefore non-refundable. This excludes the €500 deposit per person which is non-refundable.

If between planning time and/or during actual travel, circumstances require changes, Embrace Your Odyssey and its suppliers, reserve the right to cancel or vary your  itinerary and substitute components of any aspect of the Retreat, including but not limited to accommodation, Facilitators, boats, surface transportation, security matters, food, amenities, any items listed in the RETREAT STRUCTURE section of this document and any items not listed that are associated with the Retreat. Alternatives will be offered when possible. Embrace Your Odyssey cannot be held responsible for any closures, necessary itinerary changes, or curtails for any reason. These changes will not be considered material changes and will not be considered cause for cancellation by the Participant. Normal cancellation penalties still apply if the Retreat has been changed. 

PARTICIPANT AVAILABILITY: The availability of each boat on this Retreat is based on a minimum number of Participants. Embrace Your Odyssey makes every effort to ensure that boats meet their minimum requirements. However, if the group drops below the minimum number of Participants, cancellation of the boat may occur at the sole discretion of Embrace Your Odyssey. In such case, Participants will be advised at least 30 days prior to departure.  Embrace Your Odyssey reserves the right to change the departure date. We may offer alternative dates. You may choose to accept these arrangements or to cancel your booking, in which case a refund will be provided less the deposit which is always non-refundable.

UNUSED ARRANGEMENTS: Amenities and activities in the Retreat are listed in the RETREAT STRUCTURE section on the website (www.embraceyourodyssey.com), they are subject to change. The amenities come as part of the Retreat package and are voluntary. You may choose NOT to participate in any of the Retreat activities or refuse amenities, but you may not receive a refund for activities, accommodations, amenities, services or any other aspect of the Retreat that you do not use or engage with. Changes to amenities and activities for individuals may be considered on a case by case basis. There is a change request fee of €75  in addition to any change attempt. If Embrace Your Odyssey, receives a change request, approves the request, attempts to make the change, and the change is not possible, this fee still applies. 



 

SESSION CANCELLATION: The following policy applies to all private sessions associated with the Embrace Your Odyssey retreat. Each Participant is entitled to a total of three (3) sessions associated with the purchase of the Embrace Your Odyssey Retreat experience.  A session is defined as a forty five (45) minute scheduled block of time with an Inspirer associated with Embrace Your Odyssey. These are non transferable; they must be used by the Participant associated with the retreat booking. 

Pre-Odyssey Preparation session must be scheduled by June 1, 2024 and completed between July 1, 2024 and August 10, 2024. If you do not schedule and use your session within this time frame, you lose your right to that session. The Organizer highly recommends using your Pre-Odyssey Preparation Session as it will have a positive impact on your journey. This session has to take place before the retreat. 

In-Odyssey Session may be used during or after the Retreat and must be used before October 15, 2024. If you do not schedule and use your session by this date, you lose your right to that session. During the Retreat, you will discuss with your Inspirer to find a time for your session. Due to time limitations, Participants may not book more than one coaching session during the trip. This Session is meant to take place during the Retreat but may not due itinerary changes, lack of availability, or the Participant having so much fun doing other activities. That is the purpose of the extension. 

The Post-Odyssey Session must be used after the retreat between September 7, 2024 and October 15, 2024. If you do not schedule and use your session by October 15, 2024, you lose your right to that session. 

These sessions are available once you have paid for the trip in full. Full payment for the trip must be completed before your first session. If payment is not received by your first session, it will be treated as a session cancellation, and you will lose your right to that session. If you would like to request a replacement session, you may. If your request is granted, the fee for the replacement session will be €250. All terms and conditions apply to the replacement session.  No refunds will be given for missed or unused sessions. 

 

SESSION RESCHEDULING: You may reschedule your private session up to 3 days prior to your session. There will be a rescheduling fee of €50. A rescheduling request made less than 3 days prior to the appointment is treated as a cancellation and replacement session request (see above). 

 

FORCE MAJEURE: Embrace Your Odyssey assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or Suppliers and their facilities, or any other unforeseen circumstances or any other factors unforeseen by Embrace Your Odyssey that impacts negatively on, or hampers, the Organization’s ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, the Organizer will not be required to refund any money to you, although if we can recover monies from our suppliers, we will refund these to you lest planning fees in the amount of €600 per guest. The deposit is always non-refundable. 

 

COVID19 CANCELLATION POLICY: For trip cancellations or postponements made in connection with COVID-19, special terms apply. 

Unfortunately, there are circumstances beyond any of our control regarding the global pandemic which has had and continues to have unfortunate and unforeseen consequences. At this time, Embrace Your Odyssey is unable to provide refunds due to travel changes associated with COVID19 or developments related to the virus. Please ensure that your travel insurance is able to protect you in the event of such changes. 

In the event you have to cancel your participation in this retreat, you will still have the option to receive one private Session in lieu of a return of your deposit.

We appreciate your understanding of our cancellation policy, which is designed to balance flexibility with the commitments required for successful retreat planning. If you have any questions or need further assistance, please contact us at embraceyourodyssey@gmail.com.

 

EXPENSES BEYOND THE SCOPE OF THE RETREAT: Regardless of the circumstances of cancellation, Embrace Your Odyssey will not be liable for any additional costs incurred outside of cost of the Retreat including but not limited to visa and passport fees, travel insurance, or any other purchases made by the Participant in anticipation of the tour.

If the reason for cancellation is covered under the terms of your travel protection plan you may be able to reclaim these charges, for this reason we strongly encourage the purchase of a travel protection plan including additional cancel for any reason coverage. 

By booking this Retreat, you are agreeing to these Terms and Conditions. 

 

TRAVEL PROTECTION: Embrace Your Odyssey strongly recommends the purchase of travel protection coverage including “cancel for any reason” coverage if and when available. Should you fail to purchase travel protection coverage, Embrace Your Odyssey shall not be liable to any losses you experience. Embrace Your Odyssey is not liable should your chosen travel protection fail to provide coverage for any losses associated with the retreat. If you are unable to attend the Retreat for any reason, including but not limited to, your cancellation, Embrace Your Odyssey determines that you are not able to attend for any reason, cancellation, transfer or any reason not included in this document, Embrace Your Odyssey will not be liable for any incurred expenses including but not limited to airfare and other travel expenses that would have been associated with the Retreat.

PHOTO AND VIDEO RELEASE I understand that I may be photographed or filmed during this Retreat, I hereby grant Embrace Your Odyssey, its representatives, assigns, and employees the right to take photographs and/or video recordings of me in connection with the Embrace Your Odyssey event/retreat and connected events. I authorize Embrace Your Odyssey to use and publish the same in print and/or electronically for advertising, marketing, web design, social media and any purposes that arise. 

I agree that Embrace Your Odyssey may use such photographs and/or video recordings of me with or without my name and for any lawful purpose, including but not limited to publicity, illustration, advertising, and web content.

Usage: Embrace Your Odyssey may use the photographs and/or video recordings taken at the event/retreat for promotional purposes including, but not limited to, brochures, flyers, websites, social media, and other marketing materials.

Duration: This consent and release are given in perpetuity and does not require prior approval by me.

No Compensation: I understand and agree that I will not receive any compensation for the use of my likeness in such photographs and/or video recordings.

Revocation: This consent and release can be revoked at any time in writing. I agree not to indemnify Embrace Your Odyssey in the case that a photo has been published and will give Embrace Your Odyssey a minimum of 6 months and 3 attempts of direct communication via both phone and email with each attempt at communication to adjust media so that they I am not recognizable. My request for revocation is not a guarantee that the media will be removed or adjusted.

COVID19 POLICY: 

Please see “COVID19 CANCELLATION POLICY” for information about cancellations related to COVID19. 

COVID-19 RELEASE OF LIABILITY: The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

By booking a spot on the retreat at this time, I acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for myself and any minors traveling with me, that I or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time of booking. I acknowledge that exposure to such viruses or disease is an inherent risk of traveling, which cannot be controlled or eliminated by Embrace Your Odyssey. 

I understand that due to uncertainty caused by COVID-19, Embrace Your Odyssey strongly encourages the purchase of travel protection covraction including COVID-19 coverage and that, if I fail to purchase travel protection, Embrace Your Odyssey shall not be liable to any resulting losses. 

The Organizer's Stance on Vaccination, Testing, and Personal Discretion:

Vaccination and Testing: Embrace Your Odyssey does not require proof of vaccination, and we do not verify or check vaccination records. We do not conduct COVID-19 tests for Participants. Currently, we do not enforce mask requirements but we do encourage mask use for Participants showing signs of illness and for those who are susceptible to illness. 

Participants are encouraged to assess their health before traveling for the Retreat. Participants are also encouraged to stay home if they feel unwell, exhibit COVID-19 symptoms, or have been in contact with someone diagnosed with COVID-19. Please refer to the cancellation policy for information about canceling due to COVID-19. 

Personal Discretion and Assumption of Risk: 

Voluntary Participation: By signing up for this Retreat, Participants acknowledge and voluntarily assume all risks associated with COVID-19.

Sole Responsibility: Participants accept sole responsibility for their travel decisions and participation in the Retreat. All Participants act at their own discretion and assume any associated risks. Embrace Your Odyssey holds no responsibility for individual decisions regarding vaccination, testing, or personal conduct.

Compliance with Country Requirements: Participants must comply with the COVID-19 requirements of the countries they visit. Participants must adhere to any emergency protocols implemented by local health authorities before or during the Retreat. It is the Participant's responsibility to stay informed about any updates. Embrace Your Odyssey will make an effort to alert Participants when relevant information is provided; however, we do not guarantee that all information will come directly from us.

Participant Responsibility: Each Participant is responsible for staying updated on COVID-19-related information. Embrace Your Odyssey provides alerts, when information becomes available, but may not be aware of all updates. Participants should seek information from reliable sources.

Dynamic Policy Adjustments: Our COVID-19 policy is subject to change based on evolving circumstances and legal requirements. Embrace Your Odyssey will comply with all federal and local policies as we become aware of them. 

By participating in the Retreat, you acknowledge that you understand and agree to the terms outlined in this COVID-19 policy. This comprehensive COVID-19 policy is designed to prioritize the health and safety of our Participants and may be updated in response to changing circumstances. Embrace Your Odyssey reserves the right to update this policy as needed. It is advisable to review this policy regularly for any changes.

CODE OF CONDUCT:

Participant has read the PARTICIPANT WELL-BEING WAIVER (CODE OF CONDUCT) and agrees and adheres to this Code of Conduct in order to contribute to creating a safe and positive community experience for all people in the Retreat. Participant understand that failure to adhere to the Code of Conduct may result in expulsion of the Retreat and termination of any further services, without refund.

NON-DISPARAGEMENT: 

In the event that a dispute arises between the Parties, the Parties agree and accept that the only venue for resolving such a dispute shall be in the venue set forth herein below. The Participant agrees that they neither will engage in any conduct or communications with a third party, public or private, designed to disparage the Organizer. The Participant agrees that they will not directly or indirectly, in any capacity or manner, make, express, transmit, speak, write, verbalize or otherwise communicate in any way (or cause, further, assist, solicit, encourage, support, or participate in any of the foregoing), any remark, comment, message, information, declaration, communication or other statement of any kind, whether verbal, in writing, electronically transferred or otherwise, that might reasonably be construed to be derogatory or critical of, or negative toward, the Organizer or any of its programs, members, owner, directors, officers, Affiliates, subsidiaries, employees, agents, Facilitators, or representatives.

REPRESENTATION: 

I am over 18 (eighteen) years of age, and am emotionally, medically, and physically able to participate in the Retreat.


 

COVENANT NOT TO SUE:

I will not start any lawsuit or other court action against the Organizer, facilitators, directors, officers, employees, volunteers, representatives, agents, activity holders, partners, contractors, and/or sponsors. Nor will I join any such proceeding, including any claim for money damages. I acknowledge and agree that I am entering a covenant not to sue the Organizer and aforementioned parties in any capacity, including to hold the Organizer and aforementioned parties liable for any injury, loss, or damage sustained by me or my property, even if it is due to the Organizer’s negligence or omission. I also waive the right of any of my insurers’ to make any such claim.


 

RESOLUTION OF DISPUTES: 

If not resolved first by good-faith negotiation between you and the Organizer, every controversy or dispute relating to this Agreement will be submitted to the American Arbitration Association.

You and the organizer agree to give up any rights to litigate claims in a court or before a jury or to participate in a class action or representative action with respect to a claim. Other rights that you would have if you went to court, such as access to discovery, also may be unavailable or limited in arbitration.

Any and all disputes between you and the Organizer, its agents, employees, officers, directors, principals, successors, assigns, subsidiaries, affiliates, or independent contractors, including Inspirers, (collectively for purposes of this section, “the Parties”), including disputes arising from or relating to these Terms of Use, the Privacy Policy, Terms and Conditions, Liability Waivers, Well Being / Code of Conduct Waivers, and their interpretation or the breach, termination or validity thereof, communications between you and the Organizer, the reliance on any advice provided by such independent contractors, or other programs, services or promotions provided by the Organizer. Including disputes about the validity, scope or enforceability of this arbitration provision will be settled by binding arbitration For purposes of this section, these Terms of Use and related transactions will be subject to and governed by the Federal Arbitration Act, 9 U.S.C. sec. 1-16 (FAA). To the extent state law applies to any portion of a proceeding brought by you or us, the applicable law will be the law of the state of your residence, as determined based on your shipping address on file with EmbraceYourOdyssey.com. At your election, the arbitration will take place by telephone or based on the parties’ written submissions. Notwithstanding the above, you can bring any individual claim in small claims court consistent with the jurisdictional limitations of such court.

Prior to initiating any arbitration, the initiating party will give the other party at least 90-days' advanced written notice of its intent to file for arbitration. Embrace Your Odyssey will provide such notice by e-mail to your e-mail address on file with EmbraceYourOdyssey.com and you must provide such notice by e-mail to embraceyourodyssey@gmail.com. During such 90-day notice period, the parties will endeavor to settle amicably by mutual discussions any disputes. Failing such amicable settlement and expiration of the notice period, either party may initiate arbitration. The arbitrator will have the power to grant whatever individual relief would be available in court under law or in equity and any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction. This provision is a precondition to any arbitration demand.

The Parties agree that any covered dispute hereunder will be submitted to arbitration on an individual basis only. Neither Embrace Your Odyssey nor you are entitled to arbitrate any covered dispute as a class, representative or private attorney action and the arbitrator(s) will have no authority to proceed on a class, representative or private attorney general basis. If any provision of the agreement to arbitrate in this section is found unenforceable, the unenforceable provision will be severed and the remaining arbitration terms will be enforced (but in no case will there be a class, representative or private attorney general arbitration).

Notwithstanding any provision in these terms to the contrary, we agree that if the Organizer makes any future material change to this dispute resolution provision, it will not apply to any individual claim(s) that you had already provided notice to Embrace Your Odyssey. In the event that this arbitration agreement does not apply to a given dispute, then the parties agree to the exclusive jurisdiction of the state and federal courts in Los Angeles County, California to resolve such claims. The Parties shall cooperate in exchanging and expediting discovery as part of the arbitration process. The written decision of the arbitrators (which will provide for the payment of costs) will be absolutely binding and conclusive and not subject to judicial review, and may be entered and enforced in any court of proper jurisdiction, either as a judgment of law or a decree in equity, as circumstances may indicate.

All claims against the Organizer or Facilitators must be lodged within 100 days of the End Date of the Retreat or otherwise be forfeited forever. 


 

INDEMNIFICATION:

I agree to defend and indemnify the Organizer and the Organizer’s officers, employers, employees, contractors, directors, related entities, trustees, affiliates, and successors and hold them harmless against any and all legal claims and demands,  including without limitation, claims, damages, judgments, awards, settlements, investigations, costs, attorneys fees, and disbursements - which may arise from or relate to the offering of or my participation in the Retreat, my conduct or actions during the retreat, or in any way related to the services provided by the Organizer, excluding, however, any such expenses and liabilities which may result from a breach of this Agreement or gross negligence or willful misconduct by Embrace Your Odyssey, LLC.  I shall defend the Organizer in any legal actions, regulatory actions, or the like arising from or related to this Agreement.


 

GOVERNING LAW: 

These Terms and Conditions shall be governed by and construed in accordance with the internal laws of California without giving effect to any choice or conflict of law provision or rule. Each party irrevocably submits to the exclusive jurisdiction and venue of the federal and state courts located in the following county in any legal suit, action, or proceeding arising out of or based upon these terms: Los Angeles.


 

SEVERABILITY/WAIVER:

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall nevertheless continue in full force. 

 

VOLUNTARY AGREEMENT: 

Participant declares and represents that no promise, inducement, or agreement not herein expressed has been made to Participant to enter into this release.

Informed Consent:
